This policy explains how TapIfLost handles notices of alleged copyright infringement and counter-notifications where permitted by law.

TAPIFLOST respects the intellectual property rights of others and expects users of the Services to do the same. This DMCA and Copyright Policy explains how TAPIFLOST responds to notices of alleged copyright infringement and how users may submit counter-notices where permitted by law.

This Policy applies to content made available through TAPIFLOST-controlled Services, including user-submitted content, profile content, messages or uploads where legally appropriate, and any other materials within the scope of TAPIFLOST’s control.

1. Reporting Alleged Copyright Infringement

If you believe that content made available through the Services infringes your copyright, you may submit a written notice containing substantially the following information:

  1. identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered, a representative list;
  2. identification of the allegedly infringing material and information reasonably sufficient to permit TAPIFLOST to locate it;
  3. your name, address, telephone number, and email address;
  4. a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  5. a statement, under penalty of perjury where required by law, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf; and
  6. your physical or electronic signature.

Incomplete notices may delay review or prevent action.

2. TAPIFLOST Response to Notices

Upon receipt of a facially valid copyright notice, TAPIFLOST may, in its discretion and as appropriate under applicable law:

  • remove or disable access to the identified material
  • notify the affected user
  • request additional information
  • preserve records relating to the matter
  • take action under the Terms of Service or Acceptable Use Policy
  • terminate repeat infringers in appropriate circumstances

TAPIFLOST may also decline to act on notices that are facially deficient, abusive, clearly unfounded, or outside the scope of copyright law.

3. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to TAPIFLOST. A valid counter-notification should include:

  1. identification of the material that was removed or disabled and its location before removal;
  2. your name, address, telephone number, and email address;
  3. a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled due to mistake or misidentification;
  4. a statement that you consent to the jurisdiction of the appropriate court as required by applicable law for DMCA counter-notices, and that you will accept service of process from the person who submitted the original notice or that person’s agent; and
  5. your physical or electronic signature.

If TAPIFLOST receives a valid counter-notification, we may restore the material in accordance with applicable law unless the complaining party files an action seeking a court order and timely informs us as required.

4. Repeat Infringer Policy

TAPIFLOST may terminate or restrict accounts of users determined, in TAPIFLOST’s discretion, to be repeat infringers or to have repeatedly submitted infringing content.

5. Misrepresentations

Submitting knowingly false, misleading, abusive, or bad-faith copyright notices or counter-notices may subject the sender to legal liability. TAPIFLOST reserves all rights in response to abusive or fraudulent submissions.

6. Scope Limitations

TAPIFLOST is a service provider and platform operator. We do not independently verify all user-submitted content and are not obligated to pre-screen all materials. This Policy does not constitute legal advice or a legal determination regarding ownership, fair use, license scope, or infringement.

7. Submission Method

Copyright notices and counter-notices should be submitted through the legal or support contact channels made available on tapiflost.com, with sufficient detail for prompt review and routing.

8. Reservation of Rights

TAPIFLOST reserves the right to remove content, refuse content, preserve evidence, disclose information where permitted or required by law, and take any other action it deems appropriate to protect rights, users, the Services, and legal compliance.
